Terms of Use
These terms are an agreement between you and Manan Sharma, the founder and publisher of Ziva, based in Udaipur, Rajasthan, India ("Ziva", "we", "us"). By creating an account or using Ziva, you agree to them. If you don't agree, please don't use Ziva.
The short version
- Ziva is for adults, 18 and over.
- Ziva gives general wellness guidance, not medical advice. Its plans are written by AI and can be wrong. Check with a doctor before big changes, and check food labels for allergens yourself.
- Subscriptions are billed by Apple and renew automatically until you cancel in Settings on your iPhone or iPad. Refunds go through Apple.
- Chat has fair-use limits so Ziva stays fast and affordable for everyone.
- Your plan is yours for personal use. Please don't misuse the service.
1. Who can use Ziva
You must be at least 18 years old and able to form a binding contract. You sign in with your Apple Account; keep your devices and that account secure, because anyone who can use them can use your Ziva account.
2. What Ziva does
Ziva builds a weekly meal plan, workouts, a grocery list and reminders from your answers, and lets you ask Ziva in chat to change them. Ziva proposes changes; nothing in your plan changes until you confirm it. Your plan is stored on your device, as our Privacy Policy explains, so deleting the app, signing out or deleting your account removes it.
We may improve, change or stop parts of Ziva over time. If we stop the service entirely while you have a paid subscription, we'll tell you in advance.
3. Health and safety: please read
- Not medical advice. Ziva provides general information about food and exercise. It is not a doctor, dietitian or trainer, and it doesn't diagnose, treat or prevent any condition.
- Talk to a doctor first if you are pregnant or breastfeeding, have or have had an eating disorder, have diabetes, heart, kidney or any other medical condition, take medication affected by diet or exercise, or are planning a large change in weight. Don't use Ziva in place of professional care.
- AI can be wrong. Plans, calorie and nutrient figures, recipes and exercise suggestions are generated by AI and are estimates. Use your own judgement and don't rely on them for medical decisions.
- Allergies and intolerances: Ziva tries to respect what you tell it, but it can make mistakes. Always check ingredients and food labels yourself.
- Exercise at your own risk. Warm up, use proper form and equipment, and stop if you feel pain, dizziness or shortness of breath. Ziva adapts to the injuries you report, but it can't see you.
- If you feel unwell, or are in crisis, contact a medical professional or your local emergency number. Ziva is not an emergency service.
4. Subscriptions and payment
- Ziva needs an active subscription to build and change plans. Prices and periods (yearly or monthly) are shown in the app before you buy and may vary by country.
- Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel on your iPhone or iPad in Settings → your name → Subscriptions.
- If we change the price, Apple tells you beforehand as its rules require, and you can cancel before it applies.
- Refunds are handled by Apple under its policies, at reportaproblem.apple.com. We can't issue refunds ourselves.
- Deleting your Ziva account does not cancel your subscription. Cancel it in Settings as well.
5. Fair use
Each chat message and plan uses paid AI processing. To keep Ziva fast and affordable, accounts have usage limits over rolling periods (for example per hour, per day and per week). They are set well above normal personal use. If you reach one, Ziva tells you when you can continue. We may adjust these limits to protect the service.
6. Acceptable use
You agree not to:
- use Ziva for anyone other than yourself, or resell or share access to it;
- use bots, scripts or other automated means to access Ziva, or try to get around usage limits, security or the paywall;
- copy, modify, reverse engineer or decompile the app, except where the law allows it;
- send content that is illegal, abusive, sexually explicit, or meant to harm yourself or others, or try to make Ziva produce such content;
- interfere with Ziva's servers or other users.
Chat messages are checked automatically for safety. We may refuse requests that break these terms.
7. Your content and your plan
What you type and the plan Ziva makes for you are yours. You give us permission to process them only as needed to run Ziva, as described in the Privacy Policy. You may use your plan for your own personal, non-commercial purposes.
The Ziva app, its design, the Ziva character, its text, images and software belong to us or our licensors and are protected by law. These terms give you a personal licence to use them, not ownership.
8. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Ziva app on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, for your personal, non-commercial use.
9. Ending your use
You can stop using Ziva at any time, and delete your account in the app (Profile → Delete account). We may suspend or close an account that seriously or repeatedly breaks these terms, after warning you where reasonable. Sections 3, 7, 10, 11 and 13 continue to apply after your use ends.
10. Disclaimers
Ziva is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that Ziva will be uninterrupted, error-free, or that its plans will achieve any particular result, such as weight loss or fitness gains. Results depend on many things outside our control. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of Ziva, and our total liability to you for any claim is limited to the amount you paid for Ziva in the 12 months before the claim. We don't exclude liability that can't legally be excluded, such as liability for death or personal injury caused by negligence, or for fraud.
12. Apple-specific terms
Because you got Ziva from the App Store, these terms also include the following, which apply in your relationship with us and Apple:
- Agreement with us, not Apple. These terms are between you and us only, not with Apple Inc. We, not Apple, are solely responsible for Ziva and its content.
- Scope of licence. Your licence is limited to using Ziva on Apple-branded products you own or control, as the App Store Usage Rules permit (section 8).
- Maintenance and support. We are solely responsible for maintenance and support of Ziva. Apple has no obligation to provide any maintenance or support.
- Warranty. If Ziva fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Ziva, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Ziva; any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are our responsibility, to the extent not excluded by these terms.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Ziva or your possession or use of it, including product liability claims, claims that Ziva fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that Ziva or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about Ziva go to us (section 14).
- Third-party terms. You must comply with applicable third-party terms when using Ziva, such as your mobile data provider's.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Governing law and disputes
These terms are governed by the laws of India. The courts at Udaipur, Rajasthan, will hear any dispute, except that if you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts. Before going to court, please contact us so we can try to resolve the issue informally.
14. Changes and contact
We may update these terms. We'll change the date at the top, and if a change materially affects you, we'll tell you in the app before it takes effect. If you keep using Ziva after that, the new terms apply.
